Negotiations Update: Summer 2012

  

Status of Negotiations

The Tredyffrin/Easttown School District has been negotiating a new Collective Bargaining Agreement, or contract, with the Tredyffrin/Easttown Education Association (TEEA) since January 2012. Despite the T/E School District's desire to negotiate a contract with the TEEA, a new contract is not in place due to substantial differences in bargaining positions. The T/E School District is committed to creating a compensation package which is reflective of the unprecedented economic challenges facing the T/E School District community and which allows for student success and fiscal sustainability now and in the future.

 

With contract negotiations between the T/E School District and the TEEA at an impasse, the TEEA unilaterally requested fact finding on June 19, 2012. As such, a neutral third party known as a fact finder, who is assigned by the Pennsylvania Labor Relations Board (PLRB), will examine both parties' proposals and make recommendations based on the proposals.

 

Fact Finding Process

The fact finder has forty days to issue a report that contains recommendations for a new contract. Prior to issuing the report, the fact finder will conduct private hearings to take evidence on the demographics of the school district, the ability of the school district to pay for the total contract proposal and evidence on each one of the issues in dispute. The fact finder will develop a report for consideration by both parties.

 

After the fact finder issues the report on July 30, 2012, each side will have ten days to notify the PLRB whether it will accept or reject the report in its entirety. The T/E School Board plans to meet on August 9, 2012 at 8:00 pm in the T/E Administration Offices (TEAO) at 940 West Valley Road, Suite 1700 in Wayne, to consider the fact finder's report. If one or both parties reject the report, it will be made public. No less than five days and no more than ten days after the report is made public, each side must again notify the PLRB on whether it will accept it. To adhere to this requirement, the T/E School Board will meet on August 23, 2012 at 8:00 pm at the TEAO if necessary.

 

The fact finder's report will become the contract if both parties accept the report. It should be noted that the T/E School District has reviewed recent outcomes of fact finding. There appears to be a tendency for the fact finding process to "look backward" and make recommendations based on past contract settlements in the region without sufficient regard to the current economic situation. Over the past year, two Chester County school districts were involved in fact finding and in both situations, no contract settlement was achieved.

 

Entering Status Quo on July 1, 2012

Since there was no new contact as of its June 14, 2012 meeting, the T/E School Board passed a resolution on the continuation of the previous contract, known as status quo. In keeping with the law, the T/E School District and the TEEA will enter status quo on July 1, 2012. Status quo means:

  • T/E teachers' salaries will be frozen as of their salary level based upon the established 2011-2012 salary. Teachers will continue to receive their salary at the current rate until the earlier of: (1) a strike or lockout within the terms of Act 88 of 1992; or (2) the entry into a new contract.
  • T/E teachers' current health care benefit will remain the same and teachers will pay their contractual share for health benefit premiums depending upon the health benefit plan opted for by the employee until there is a new contract.

The T/E School District will continue to keep the community  

updated on negotiations milestones so that the process and issues are understood by those paying for the contact. School Board Adopts Final Budget and Approves Memorandum of Understanding with TEEA to Defer Demotions for 2012-2013

On June 14, 2012 the School Board approved the 2012-2013 final budget comprised of $110,334,406 in anticipated spending needed for operations, a $10,387,537 transfer of fund balance to the capital reserve fund and $5,150,000 in contingencies, totaling $125,871,943. 

 

The 2012-2013 budget includes a property tax increase of 3.3%, or .6154 mills, which will produce approximately $3.0 million in revenue. This tax rate increase translates into an average annual increase of about $155 to the average assessed T/E homeowner. T/E homeowners eligible for the homestead/farmstead exclusion under Act 1 will receive a reduction of $177 on their 2012 property tax bills from State allocated gaming revenue.

 

At the June 14, 2012 meeting, the T/E School Board agreed to a Memorandum of Understanding with the Tredyffrin/Easttown Educaton Association (TEEA). The Board agreed to defer the consideration of demotions of professional staff for economic reasons for the 2012-2013 school year and the TEEA agreed that its members will not be entitled to any advanced studies tuition reimbursement from the District for any course taken during the 2012-2013 school year unless the TEEA member is at the Bachelor's column steps 1 through 10 on the salary schedule or is enrolled in a preapproved Master's degree program.

Update on Officer Meoli

 

Officer Larry Meoli is sore, but in good spirits at home and on the road to recovery. He and the rest of the Police Department want to thank the community for the tremendous outpouring of support. Police Superintendent, Anthony Giaimo, added that the Department also "deeply appreciates the response and cooperation from the Chester County District Attorney's Office, Chester County detectives, responding law enforcement agencies, and fire companies. We are pleased and thankful that our officer will recover from his injuries."

 

Officer Meoli was struck by a car while responding to a burglar alarm on Old Eagle School Road in Wayne on the evening of May 18th. He suffered injuries to his head, arm, and chest.

 

New Director of Planning & Zoning

 

Congratulations to Township employee, Matt Baumann, on his recent promotion to Director of Planning & Zoning. Mr. Baumann has been serving as the Township Zoning Officer since July of 2011.

Residential Compost Site Update

 

Through the generosity of volunteers, the Cassatt Road site will be open on the following Saturdays: June 9th, 16th, and 30th, from 9 am to noon. For more information, including accepted materials, please click here.

 

Construction

 

As part of its ongoing infrastructure improvement program, Aqua Pennsylvania, Inc. will be creating detours on several roads for water main installations, including sections of: Upper Gulph Road, Woodland Road, Yellow Springs Road, Hilltop Road, and Friendship Drive.

 

PennDOT will be milling or resurfacing local state highways in neighboring Easttown in the month of June. In addition, crews will be replacing 58 curb ramps.

Summer in the Park Concert Series

 

Tredyffrin Township is partnering with F4 Fiorenza’s Food for Friends and will be collecting non-perishable foods during all our Community Events: the Concert Series and 4th of July Celebration. Food will be distributed to local food pantries in Chester County. Thank you for your generosity! Please click here for the 2012 concert schedule.

Trout Creek Stormwater Overlay District Ordinance Public Hearing

 

The next Board of Supervisors public hearing for the ordinance is on Monday, June 18th, 7:30 pm, in the Township Building. At the meeting, the Board will discuss additional amendments to the ordinance. They will not make any decisions that night. Any changes that the Board supports will be forwarded to the Tredyffrin Planning Commission for review at their next meeting on Thursday, June 21st, 7 pm, Township Building.

 

The overlay district is intended to encourage redevelopment of large properties in the Trout Creek Watershed that will include substantial public stormwater facilities to better manage runoff.

 

The Township has conducted studies to evaluate and develop recommendations to improve the condition of the Trout Creek Watershed and address flooding in the Glenhardie area. The zoning amendment is part of the implementation effort.

 

A Working Group of neighbors has been reviewing the studies and the zoning amendment, leading to their recommendations.

 

2013 Budget Discussions

 

During 2012, Tredyffrin will review the services provided by a different Township department each month at a Board of Supervisors public meeting, as well as revenue sources available to pay for those services. The goal is to engage in public dialog that will lead to goals for the 2013 budget that begins in the fall. Park maintenance, recreation programs and leaf sites will be presented Monday, June 18th, 7:30 pm.

Police Department Learning Series - Senior Crime Prevention

 

As Pennsylvania's top law enforcement officer, Attorney General Linda L. Kelly is dedicated to protecting the citizens of the Commonwealth from identity thieves & scam artists through public outreach and by prosecuting to the fullest extent of the law, those who use another's personal information to commit fraud. The Attorney General’s “Senior Crime Prevention University” presentation will make Pennsylvania's senior citizens aware of the threat of fraud and scams to the elder community, teach them how to avoid being victimized, and to make sure they know to alert local law enforcement when they are concerned about their safety and well being. The theme of the Senior Crime Prevention Outreach is "AWARE, AVOID, ALERT". Dave Shallcross of the Office of Attorney General will share the latest tricks criminals are using to commit fraud and scams in our communities.

 

Please plan to attend the Senior Crime Prevention community outreach seminar, on Thursday, June 28th, 7 pm at the Township Building.

"Buckle Up PA" Seat Belt Enforcement Mobilization

 

The Tredyffrin Township Police Department has once again partnered with the Commonwealth of PA in the “Buckle Up PA” mobilization. The goal is to gain compliance in the use of seat belts. Seat belts save lives. Please remember to always “buckle up” when driving (and buckle up your children). For those who have questions regarding child safety seats, please contact the Community Policing Unit to schedule a check and or installation. The Buckle Up PA Seat Belt Enforcement Mobilization began on May 21st and runs through June 10th, 2012.
